This Privacy Policy explains how Kaperkunde handles personal data when you visit our websites (including kaperkun.de, kaperkunde.com, kaperkunde.nl, and godutch.us), create an account, comment, subscribe, contact us, or use plek.je managed hosting services.
For hosting customers, this Policy forms part of our agreement together with the Terms of Service, Acceptable Use Policy, and Data Processing Terms.
Plain-language summary

1. Who this Policy covers
This Policy applies if you:
- visit our websites, including kaperkun.de, kaperkunde.com, kaperkunde.nl, and godutch.us
- create an account, leave a comment, subscribe to a newsletter, or become a member on a Kaperkunde website
- contact us for support, sales, or other inquiries
- sign up for or use plek.je
2. How we handle different kinds of data
2.1 Kaperkunde websites
When you interact with a Kaperkunde website, Kaperkunde is normally the controller of personal data such as:
- Name, email address, and profile information you provide when creating an account
- Comments, replies, and other content you submit
- Newsletter or membership subscription details
- Messages you send through contact or support forms
- Security, abuse, and server logs relating to our websites
- Visit or traffic data collected through our site administration tools, where enabled
- Cookie or similar data from our websites, as described in §8
2.2 Hosting customer account data
When you sign up for plek.je, pay us, or contact us about hosting, Kaperkunde is normally the controller of personal data such as:
- Name, email address, billing address, and company details
- Account, authentication, and support communications
- Payment and invoicing records processed through our payment provider
- Security, abuse, and server logs relating to hosting systems
2.3 Data processed on hosted customer sites
When visitors, members, commenters, or subscribers interact with your hosted website, you are normally the controller and Kaperkunde is normally the processor.
That hosted data may include names, email addresses, comments, membership records, newsletter data, visit or traffic data visible in your site admin, and other content you choose to collect.
Your responsibilities as site owner — including privacy notices, lawful basis, consent, cookies, retention, and data-subject requests for your end users — are described in the Terms of Service and Data Processing Terms.
Kaperkunde processes hosted customer data only to provide, secure, maintain, back up, restore, troubleshoot, and support the hosting service, or as required by law. We do not use hosted customer content for our own marketing, advertising profiles, resale, or AI training.
3. What we collect and why

We keep data only as long as needed for these purposes, unless a longer period is required by law, security, accounting, or dispute handling.
4. What we do not do
Kaperkunde does not:
- Sell personal data
- Share personal data with third parties except subprocessors needed to operate our services, as described in §5
- Use personal data for AI or machine-learning training
- Use personal data for third-party advertising or profiling
For plek.je, we also do not use hosted customer content for our own marketing, advertising profiles, resale, or AI training.
5. Subprocessors
We use carefully selected subprocessors bound by appropriate contractual obligations.
5.1 When Kaperkunde is controller
These subprocessors help us operate Kaperkunde websites and hosting accounts:

We may update this list from time to time. Material changes will be communicated with reasonable notice where practical.
5.2 When Kaperkunde processes hosted site data on your behalf
When Kaperkunde acts as a processor for your hosted website, the current subprocessor list is published at hosting/subprocessors.md.
5.3 Services you configure yourself
If you enable additional third-party services inside your hosted site — such as Mailgun for email, Stripe for payments to your readers or members, or other integrations — those are direct relationships between you and the provider. They are your responsibility and are not covered by our subprocessor lists.
6. International transfers
Kaperkunde prefers EU-based infrastructure where practical. If personal data is transferred outside the European Economic Area and safeguards are required, we use appropriate mechanisms such as adequacy decisions, Standard Contractual Clauses, or another lawful transfer tool.
7. Security
We use reasonable technical and organizational measures appropriate for a small business, including access controls, credential protection, infrastructure hardening, backups, logging, encryption in transit where practical, and security updates.
No online service can guarantee absolute security. You remain responsible for securing your account credentials and, if you use hosting, for lawful configuration of your hosted site.
8. Cookies and similar technologies
8.1 Kaperkunde websites
If our websites use cookies or similar technologies, we will describe them in a cookie notice on those sites and, where required, ask for consent before non-essential cookies are placed.
8.2 Hosted customer websites
Cookies, analytics, memberships, newsletters, and other tracking or collection on your hosted site are configured by you. You are responsible for lawful notices and consent for your visitors and members.
9. Your rights
If you are in the European Economic Area, United Kingdom, or another jurisdiction with similar rights, you may have the right to:
- Access your personal data
- Rectify inaccurate data
- Erase data in certain cases
- Restrict or object to processing in certain cases
- Data portability where applicable
- Withdraw consent where processing is based on consent
- Lodge a complaint with a supervisory authority
For hosted-site data where you are the controller, end-user requests should normally be handled by you. Kaperkunde will provide reasonable assistance as described in the Data Processing Terms.
To exercise rights relating to data Kaperkunde controls — including data from our websites or your hosting account — contact privacy@kaperkun.de. We may need to verify your identity before responding.
10. Supervisory authority
If you are in the Netherlands, you may lodge a complaint with the Autoriteit Persoonsgegevens. If you are elsewhere in the EEA, you may contact your local data-protection authority.
11. Children
Our account and hosting services are directed to adults aged 18 or older. We do not knowingly collect personal data from children through those services.
If our public websites may be accessed by minors, we do not knowingly collect personal data from children without appropriate consent where required by law.
If you use plek.je, you are responsible for ensuring your hosted site complies with applicable rules if it may be accessed by minors.
12. Marketing communications
If you create an account or contact us, we may send service-related messages about your account, billing, security, subscriptions, or the services you use.
We may also send occasional product or service news where permitted by law. You can opt out of non-essential marketing email at any time by using the unsubscribe link in the message or contacting privacy@kaperkun.de. Opting out of marketing does not affect essential service communications.
13. Data retention and deletion
We retain personal data only as long as needed for the purposes described in this Policy, including for active accounts, subscriptions, comments, support history, legal obligations, tax and accounting, security, and dispute handling.
Hosted customer data is deleted or returned according to the Terms of Service after termination or expiry, subject to backup cycles and legal retention needs. Deleted data may remain temporarily in backups until those backups expire or are overwritten.
You may request deletion of data Kaperkunde controls by contacting privacy@kaperkun.de, subject to lawful retention requirements.
14. Business transfers
If Kaperkunde is involved in a merger, acquisition, reorganization, or sale of assets, personal data may be transferred as part of that transaction subject to appropriate safeguards and notice where required by law.
15. Changes to this Policy
We may update this Privacy Policy from time to time. Material changes will be communicated with reasonable notice where practical. The effective date at the top shows the current version.

17. Online dispute resolution (consumers)
The European Commission provides an online dispute-resolution platform at https://ec.europa.eu/consumers/odr.
Kaperkunde is not obliged to participate in alternative dispute-resolution proceedings before a consumer arbitration body, but consumer mandatory rights remain unaffected.
