These Terms govern managed hosting services offered at https://plek.je. They are written in plain English and are still intended to be legally binding.
Plain-language summary
- You own your website content.
- You are responsible for what you publish, for your site’s privacy compliance, and for keeping your own important backups.
- plek.je provides managed hosting on a best-effort basis, but does not guarantee perfect uptime, perfect security, or zero data loss.
- plek.je may suspend or remove content that violates the Acceptable Use Policy or applicable law.
- plek.je limits its liability to the amount you paid in the previous 12 months.
- Hosted site data is processed under the Privacy Policy and Appendix A below.
This summary is for convenience. The full Terms below control if there is a conflict.
1. Agreement
These Terms, together with:
- Plan Details shown on the order page, proposal, invoice, or plan description
- the Privacy Policy
- the Acceptable Use Policy (“AUP”)
- Appendix A (Data Processing Terms)
- the Subprocessor List
form the Agreement between you and plek.je for the Service.
By creating an account, ordering the Service, or continuing to use the Service after the effective date, you agree to the Agreement.
A custom written agreement overrides these online Terms only where it clearly says so.
2. Definitions
- Customer, you, your — the person or entity using the Service, including anyone acting through your account.
- plek.je — the trade name under which Kaperkunde provides the Service at https://plek.je.
- Customer Content — website text, images, files, themes, comments, user submissions, databases, metadata, media, visit or traffic data stored for your site, and any other material uploaded, published, stored, or processed through your hosted site.
- Plan Details — features, limits, prices, storage, bandwidth, and other plan-specific terms shown on the order page, proposal, invoice, or plan description.
- Service — plek.je’s managed website and blog hosting, Ghost hosting, domain/DNS assistance, email configuration assistance, backups, maintenance, support, and related technical help described in §3.
3. Services covered
plek.je may provide:
- Managed website and blog hosting
- Ghost hosting
- Domain and DNS assistance
- Mailgun setup assistance
- Backup and restore assistance
- Maintenance and software updates
- HTTPS/SSL for custom domains where supported
- Email or support-form support
- Related technical help agreed in writing
Plan Details form part of the Agreement. plek.je is a managed hosting service, not a custom software-development service, unless custom development is separately agreed in writing.
4. Who these Terms apply to
These Terms apply to customers who buy or use the Service, including businesses, sole proprietors, organizations, and consumers aged 18 or older.
If you use the Service on behalf of a company or organization, you confirm that you have authority to accept the Agreement for that entity.
5. Account eligibility and responsibility
You must provide accurate account, billing, and contact information and keep it current.
You are responsible for all activity under your account, securing login credentials, using strong passwords and two-factor authentication where available, promptly reporting suspected compromise, and ensuring your users, staff, contractors, and contributors comply with the Agreement.
Losses caused by your failure to secure your account or devices are your responsibility.
Creating an account or contacting us may result in service-related communications about your account, billing, security, or the Service. Where permitted by law, we may also send occasional product news; you may opt out of non-essential marketing email as described in the Privacy Policy.
6. Intellectual property
6.1 Your content
You retain ownership of Customer Content.
You grant plek.je a limited license to host, transmit, back up, copy, display, and process Customer Content only as needed to provide, secure, maintain, and support the Service.
plek.je does not claim ownership of Customer Content.
6.2 plek.je property
plek.je retains ownership of its infrastructure, platforms, tooling, documentation, and other materials it provides as part of the Service, except Customer Content and third-party software licensed to you through the hosted platform.
You may not copy, sell, sublicense, or misuse plek.je’s proprietary materials except as needed to use the Service under the Agreement.
6.3 Third-party software
Ghost and other open-source or third-party software used in the Service remain subject to their own licenses. Ghost is open-source software released under the MIT license. You are responsible for complying with applicable third-party license terms for themes, plugins, and integrations you choose to use.
6.4 Your IP obligations
You are solely responsible for ensuring Customer Content, themes, plugins, integrations, and your use of the Service do not infringe or misappropriate third-party intellectual-property or other rights.
7. Customer responsibility for content and compliance
You are solely responsible for Customer Content and for any harm or legal claims arising from it, including your website, products, services, marketing, privacy notices, cookie notices, email lists, comments, memberships, and user submissions.
plek.je does not pre-screen all Customer Content and is not responsible for verifying legality, accuracy, ownership, or quality of Customer Content.
End-user privacy compliance for your site is your responsibility, as further described in the Privacy Policy and Appendix A.
8. Acceptable use
You must comply with the AUP, which is incorporated into the Agreement.
9. Enforcement
plek.je may investigate, throttle, suspend, restrict, remove content, disable functionality, or terminate the Service where reasonably necessary to protect the Service, respond to abuse or security threats, comply with law or upstream requirements, prevent harm or excessive resource use, or enforce the Agreement.
Where practical, plek.je will notify you and give you a chance to resolve the issue. For urgent, clearly illegal, harmful, or security-related issues, plek.je may act immediately without prior notice.
Repeated or serious violations may result in permanent termination without refund. Non-payment enforcement follows §24.
10. Notice-and-action
plek.je maintains a notice-and-action process consistent with applicable EU and Dutch requirements for hosting providers, including handling credible reports of illegal content and intellectual-property complaints.
10.1 Reporting
Reports should be sent to abuse@plek.je and should include, where possible:
- the URL or location of the content
- a clear description of the issue
- the legal or policy basis for the complaint
- contact details for the reporter
- supporting evidence reasonably needed to identify the content or issue
10.2 Our response
plek.je may forward complaints to you, require timely action, remove or restrict access to allegedly illegal or infringing material after a credible notice, and suspend or terminate repeat offenders or serious violators.
Where legally required, plek.je will provide reasons for restrictions and a reasonable opportunity to respond or appeal.
10.3 Your response
If content on your site is restricted because of a complaint, you may reply to the notice with information explaining why the content should be restored or why the complaint is unfounded. plek.je will review good-faith counter-statements along with the original complaint and applicable law before deciding whether to restore, keep restricted, or terminate the account.
11. Domains and DNS
You are responsible for owning, registering, renewing, and maintaining your domain names.
plek.je may assist with domain and DNS setup. Domain loss, expiration, registrar problems, DNS misconfiguration, registry decisions, or third-party registrar actions are your responsibility unless plek.je expressly agreed in writing to manage renewal and directly caused the loss through gross negligence or intentional misconduct.
12. Email and Mailgun
Ghost supports newsletters through email providers such as Mailgun. Two options are available:
Managed email (Easy 10k): plek.je provisions a dedicated sending domain on its Mailgun account on your behalf. A usage allowance applies; see the current plan details on the pricing page. When you use this option, Mailgun processes outbound email data as a subprocessor of plek.je — see the Subprocessor List. plek.je may adjust the allowance, suspend the managed email service, or require you to switch to a BYO configuration with reasonable notice, except where immediate action is required to prevent abuse or harm to the Service.
BYO Mailgun: You set up, maintain, and contract directly with Mailgun or another email provider. In this case, the provider is a direct relationship between you and that third party, not a plek.je subprocessor.
In both cases, you are responsible for your sending practices, newsletter content, recipient lists, and compliance with applicable law and your email provider’s terms of service. plek.je is not responsible for deliverability, inbox placement, spam-filter results, or third-party enforcement actions.
Email deliverability, inbox placement, spam-filter results, IP reputation, and third-party email availability are not guaranteed. Further email rules are in the AUP.
plek.je may disable email functionality on your hosted site for spam, abuse, compromised accounts, reputation harm, or provider requirements affecting the Service.
13. Memberships, payments, and Stripe
Ghost supports paid memberships and subscriptions through payment processors such as Stripe. You set up, maintain, and contract directly with your payment processor.
Fees paid to you through your site are collected by you, not by plek.je. You are the seller and merchant of record. plek.je is not a party to transactions between you and your readers, members, or customers and is not responsible for pricing, fulfillment, refunds, chargebacks, tax treatment, or disputes arising from those transactions.
Payment processing, refunds, chargebacks, and restricted-business rules are governed by your payment processor’s terms of service and policies between you and that provider. plek.je is not responsible for your processor’s rules, enforcement actions, account suspensions, or payment outcomes.
Payment processors you enable are not plek.je subprocessors and are not covered by the Subprocessor List unless explicitly stated in Plan Details.
You are responsible for lawful operation of memberships and payments, including consent for imported members, newsletter compliance, and required notices to your customers.
Refund requests from your readers or members should be directed to you.
14. Site analytics and visit data
Where included in your plan, plek.je may store visit or traffic data for your hosted site on infrastructure operated by plek.je.
That data is:
- owned and controlled by you
- accessible to you through your site’s admin interface
- not sold, shared with third parties, or used by plek.je for advertising or AI training
- processed by plek.je only to provide, secure, maintain, back up, restore, troubleshoot, and support the Service
You are responsible for lawful collection, retention, and use of analytics or visit data from your site, including any notices or consents required for your visitors.
15. Custom code, themes, plugins, and integrations
Custom themes, plugins, code, scripts, integrations, and third-party services are allowed only where supported by Plan Details and the hosted platform.
You are responsible for their consequences, including security, downtime, compatibility, privacy compliance, performance, and data loss.
plek.je may disable or remove custom code, themes, plugins, or integrations that create security, stability, legal, abuse, or performance risks.
16. Software updates and maintenance
plek.je may apply security, platform, Ghost, dependency, and infrastructure updates automatically.
Updates may cause compatibility issues with third-party themes, plugins, code, or integrations. plek.je will make reasonable efforts to help but is not liable for compatibility issues caused by third-party software, customer modifications, or unsupported integrations.
Scheduled maintenance may occur with reasonable notice where practical. Emergency maintenance may happen without prior notice.
17. Backups and restores
plek.je performs reasonable automated backups, currently including:
- hourly backups for approximately the last 24 hours
- daily backups for approximately the last 14 days
Backups are a safety measure, not a guarantee. You remain responsible for keeping independent copies of important content, exports, files, databases, and business records.
One reasonable restore is included for provider-caused issues. Customer-requested restores may be billed, limited, delayed, or unavailable depending on backup availability, technical feasibility, account status, and the nature of the request.
Data-loss liability limits are in §30.
18. Export and deletion
While your account is active and paid up, you may request or export your content and database where technically available.
After termination, cancellation, trial expiry, or non-payment, Customer Content may be deleted after 30 days. Free, trial, or abandoned sites may be suspended or deleted after 30 days from expiry or non-payment.
You may request earlier deletion, subject to legal, accounting, security, dispute, and backup-cycle limitations. Deleted content may remain temporarily in backups until those backups expire or are overwritten.
19. Availability
plek.je provides the Service on a best-effort availability basis. No uptime SLA is currently offered unless expressly stated in a custom written agreement.
Availability expectations do not apply to events described in §29 (force majeure), scheduled or emergency maintenance, customer-caused issues, third-party outages, abuse mitigation, security incidents, or issues caused by custom code or unsupported modifications.
20. Support
Support is provided by email or support form on a best-effort basis. Typical targets are 1–2 business days on Dutch business days, excluding Dutch public holidays.
Support covers operating the hosted platform. Unless separately agreed in writing, it excludes custom development, content or marketing work, third-party integrations, malware cleanup caused by customer actions, recovery from unsupported modifications, and legal, tax, privacy, or regulatory advice.
Occasional help with excluded items does not create an ongoing obligation to provide that help again.
21. Resource limits and fair use
Plan Details define included storage, bandwidth, and other limits.
Legitimate traffic growth, including viral traffic, is welcome. plek.je may restrict or suspend use that materially exceeds Plan Details, degrades shared infrastructure, or appears abusive, automated, or inconsistent with normal website or blog hosting.
If sustained usage materially exceeds your plan, plek.je may ask you to upgrade or adjust usage.
22. Billing, subscriptions, and taxes
Services are billed monthly or annually in advance unless otherwise agreed in Plan Details. Prices include VAT unless clearly stated otherwise.
For business customers, subscriptions renew automatically unless cancelled before renewal. For consumers, renewal and cancellation rights apply as required by mandatory consumer law.
You may cancel before the next renewal; the Service normally remains active until the end of the paid billing period. Plan upgrades, downgrades, or other changes follow the process shown in Plan Details or your account interface; charges may be prorated where applicable.
plek.je may change prices with 30 days’ notice for the next billing period. You are responsible for keeping payment details current. Unjustified chargebacks may result in suspension and recovery of fees, costs, or losses.
23. Trials, refunds, and consumer withdrawal rights
plek.je may offer free trials or free tiers, which may be changed, limited, suspended, or discontinued at any time.
For business customers, fees are non-refundable after the trial period or renewal, except where required by law or expressly agreed in writing.
For consumers, EU withdrawal rights may apply. If you request immediate performance of a digital service during the withdrawal period, plek.je may ask you to acknowledge that your withdrawal right may be limited or lost once the service has been fully performed, where permitted by law.
Nothing in the Agreement limits mandatory consumer rights that cannot legally be waived. Consumer dispute information is in the Privacy Policy.
24. Non-payment
If payment fails or an invoice is overdue, plek.je may provide a 7-day grace period, then suspend the Service. If payment remains unresolved, plek.je may terminate the Service and delete Customer Content after 30 days as described in §18.
Downtime, data loss, missed emails, SEO effects, or business losses caused by suspension or termination for non-payment are excluded from liability under §30.
25. Third-party services
The Service may depend on third-party providers such as those listed in the Subprocessor List, plus domain registrars, payment processors you enable, themes, plugins, and other software vendors.
Your use of third-party services is at your own risk. You are responsible for third-party fees unless Plan Details clearly say they are included. Third-party failures are excluded from liability under §30.
26. Privacy and data protection
Privacy practices for data Kaperkunde controls are described in the Privacy Policy.
Where plek.je processes personal data in Customer Content on your behalf, Appendix A applies. The current Subprocessor List is incorporated by reference into Appendix A.
27. Confidentiality
Each party must protect the other party’s non-public business, technical, account, security, and commercial information using reasonable care.
Confidentiality obligations do not apply to information that is public, already known without restriction, independently developed, lawfully received from another source, or required to be disclosed by law.
28. Security
plek.je will use reasonable technical and organizational measures to protect the Service. Detailed measures for hosted personal data are in Appendix A6.
No hosting service can guarantee absolute security. You must promptly notify plek.je of suspected security incidents affecting your site or account.
29. Force majeure
plek.je is not liable for delay or failure caused by events outside its reasonable control, including internet outages, upstream provider failures, war, terrorism, civil unrest, natural disasters, fire, flood, labor disputes, government action, legal orders, power failures, major cyberattacks, or failures of third-party services.
30. Indemnity, disclaimers, and limitation of liability
30.1 Indemnity
You agree to indemnify and hold plek.je harmless from claims, damages, losses, liabilities, costs, and expenses arising from Customer Content, your site or business, your breach of the Agreement, your violation of law, alleged infringement of third-party rights, your custom code or integrations, or abuse connected to your account.
This indemnity does not apply where the claim was caused by plek.je’s intentional misconduct or gross negligence.
30.2 Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent allowed by law, plek.je does not guarantee uninterrupted, error-free, secure, or loss-free operation, compatibility with all third-party services, or suitability for every business purpose. plek.je does not provide legal, tax, privacy, accounting, financial, medical, or regulatory advice.
30.3 Limitation of liability
To the maximum extent allowed by law, plek.je is not liable for lost profits, revenue, business, opportunities, reputational harm, interruption of use, downtime, loss or corruption of data, indirect or consequential damages, third-party failures, customer-caused issues, or security incidents not caused by plek.je’s gross negligence or intentional misconduct.
plek.je’s total liability for all claims relating to the Service is capped at the amount you paid for the affected service in the 12 months before the event giving rise to the claim.
Nothing in the Agreement excludes or limits liability that cannot legally be excluded or limited, including mandatory consumer rights, intentional misconduct, or gross negligence where exclusion is not permitted.
31. Suspension and termination
You may cancel according to Plan Details and §22.
plek.je may suspend or terminate the Service if you breach the Agreement, fail to pay under §24, create legal or operational risk, are required to do so by law or an upstream provider, or if continuing the Service would harm plek.je, other customers, infrastructure, or third parties.
plek.je may terminate free or trial services at any time. Termination does not relieve you of payment obligations incurred before termination.
Export, deletion, and backup timing follow §§17–18.
32. Changes to the service or Terms
plek.je may update the Service, Plan Details, infrastructure, pricing, and these Terms. Material changes affecting paid customers will receive reasonable notice where practical.
Continued use after the effective date of updated Terms means acceptance, except where mandatory law requires a different process.
33. Use of customer name or logo
For business customers, plek.je may list your name as a customer unless you opt out by contacting support@plek.je. plek.je will not use your logo in marketing or publish confidential project details without permission.
34. General terms
Entire agreement. The Agreement is the entire agreement between the parties regarding the Service and supersedes prior discussions on the same subject, except a custom written agreement that clearly overrides these Terms.
Severability. If any provision is invalid or unenforceable, the remaining provisions remain in effect.
No waiver. Failure to enforce a provision is not a waiver of that provision or any other provision.
Survival. Provisions that by nature should survive termination — including Customer Content ownership, confidentiality, indemnity, disclaimers, liability limits, payment obligations, privacy and data-protection terms, and dispute terms — survive termination.
No agency. The parties are independent contractors. Nothing in the Agreement creates a partnership, agency, or employment relationship.
Assignment. You may not assign or transfer the Agreement without plek.je’s prior written consent. plek.je may assign the Agreement as part of a merger, acquisition, reorganization, sale of assets, or transfer of the hosting business.
Notices. Routine contact may be by email to the address on your account. Formal legal notices to plek.je must be sent to legal@plek.je and to your legal or account email for notices to you. Formal notices take effect when sent by email unless applicable law requires another method.
Language. The English version of these Terms controls unless plek.je publishes another language version and states that it controls.
35. Governing law and disputes
These Terms are governed by Dutch law.
The parties will first try to resolve disputes informally by contacting legal@plek.je.
If a dispute cannot be resolved informally, the courts of the Netherlands have jurisdiction, unless mandatory consumer law gives a consumer the right to bring a claim in another forum.

Appendix A: Data Processing Terms
These Data Processing Terms (“DPA”) apply where plek.je processes personal data on your behalf as a processor under applicable data-protection law, including the GDPR.
If the DPA conflicts with the main Terms on processing matters, the DPA prevails to the extent of the conflict.
Privacy practices for data Kaperkunde controls as an independent controller are in the Privacy Policy. Roles, subprocessors, and customer responsibilities for hosted data are summarized there and detailed below.
A1. Processing instructions
plek.je will process personal data on documented instructions, including the Agreement, your use of the Service, support requests, and written configuration instructions.
plek.je may also process personal data where required by law and, where legally permitted, will notify you of that requirement.
A2. Nature and purpose of processing
plek.je processes personal data to provide, secure, maintain, back up, restore, troubleshoot, and support managed hosting services.
A3. Types of personal data and data subjects
Depending on your use, hosted personal data may include website user data, names, email addresses, usernames, profile information, comments, newsletter or membership data, IP addresses, logs, device or browser data, visit or traffic data stored for your site, payment or subscription metadata processed through your hosted platform, and any other personal data you upload or collect.
Data subjects may include your staff, contractors, visitors, members, subscribers, commenters, and other people whose data is included in Customer Content.
A4. Duration
Processing continues for the duration of the Service and afterward only as needed for deletion, export, backup expiry, legal obligations, security, disputes, and accounting, as described in §18 and the Privacy Policy.
A5. Confidentiality
plek.je will ensure that people authorized to process hosted personal data are subject to appropriate confidentiality obligations.
A6. Security measures
plek.je will use reasonable technical and organizational measures appropriate for a small managed hosting provider, which may include access controls, secure credentials, infrastructure hardening, backups, logging and monitoring, encryption in transit where practical, separation of customer environments where practical, limited administrative access, and security updates.
You remain responsible for secure passwords, account access, lawful configuration, website settings, themes, plugins, custom code, and end-user compliance.
A7. Subprocessors
You authorize plek.je to use subprocessors under appropriate contractual obligations.
The current list is maintained at subprocessors.md and incorporated by reference. plek.je may update that list as described there and will handle objections on reasonable data-protection grounds where required by law.
Services you set up and maintain yourself inside your hosted site — such as Mailgun, Stripe, or other integrations — are direct relationships between you and the provider and are not subprocessors appointed by plek.je unless expressly stated in Plan Details.
A8. International transfers
plek.je may use EU and non-EU subprocessors. Where personal data is transferred outside the European Economic Area and safeguards are required, plek.je will use appropriate safeguards such as adequacy decisions, Standard Contractual Clauses, or another lawful transfer mechanism.
A9. Assistance
Taking into account the nature of the processing and information available to plek.je, plek.je will provide reasonable assistance with data-subject requests, security obligations, personal-data breach obligations, data-protection impact assessments, and prior consultations with supervisory authorities.
Assistance beyond ordinary support may be billed at then-current rates unless the issue was caused by plek.je’s breach of this DPA.
A10. Personal-data breach notice
plek.je will notify you without undue delay after becoming aware of a personal-data breach affecting hosted personal data processed on your behalf, with information reasonably available to plek.je.
You are responsible for deciding whether notice to data subjects, regulators, or others is required.
A11. Deletion or return
At the end of the Service, plek.je will delete or return hosted personal data according to §18, unless continued storage is required by law, accounting rules, security needs, dispute handling, or backup-cycle limitations.
A12. Audit and information
plek.je will make available information reasonably necessary to demonstrate compliance with this DPA. Audits must be reasonable, limited, and scheduled in advance. plek.je may satisfy audit requests through documentation, security summaries, third-party reports, or written responses.
You may not access systems or data belonging to other customers.
A13. Customer responsibilities
You are responsible for having a lawful basis for processing, providing required privacy and cookie notices, handling consent where required, responding to data-subject requests for your end users, configuring your site lawfully, and deciding what personal data is collected, stored, retained, or deleted.
